Todd County Board of Commissioners 

March 15, 2016

 

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 15th day of March, 2016 at 9:00 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners present. 

Approval of Agenda

On motion by Neumann and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote. To approve the agenda as presented. 

Routine Business

On motion by Neumann and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve meeting minutes from March 1, 2016 Meeting Minutes as read. 

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Commissioner Warrants number 42892 through 43000 in the amount of $77,929.17 and HHS Warrants in the amount of $58,844.96.

On motion Neumann and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the Auditor Warrants number 226811 through 226996 in the amount of $1,471,102.64.

On motion by Kneisl and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To approve a one year On and Off Sale 3.2 Malt Liquor License for Clarissa Ballroom at the address of 19281 Kotter Road, Clarissa, MN in Eagle Valley Township.

On motion by Kneisl and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve a one year Dance License for Clarissa Ballroom starting April 1, 2016 in Eagle Valley Township at 19281 Kotter Rd, Clarissa, MN.

On motion by Kneisl and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve a one year Set-Up license for Clarissa Ballroom in Eagle Valley Township at the address of 19281 Kotter Rd, Clarissa, MN.

On motion by Neumann and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve a one day Dance License for Diamond Point to be held July 2, 2016 in the north parking lot of Diamond Point contained by fence at 12867 Bayview Drive, Sauk Centre, MN.

On motion by Neumann and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve a one year On Sale, Off Sale, and Sunday Liquor License for T.J.’s Diamond Point Inc dba Diamond Point Supper Club/Lounge at the address of 12818 Bayview Drive, Sauk Centre, MN in Birchdale Township.

On motion by Kircher and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To approve a Seasonal On Sale, Off Sale, and Sunday Liquor License for Historic Rock Tavern LLC at the address of 11977 County 47, Grey Eagle, MN in Grey Eagle Township effective April 1, 2016 through October 1, 2016.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve a one year On Sale, Off Sale, and Sunday Liquor License for The Hub Supper Club LLC at the address of 30905 County 13, Burtrum, MN in Burnhamville Township.

On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve a one year On and Off Sale 3.2 Malt Liquor License for Knotty Pine Ballroom at the address of 30509 US 71, Browerville, MN in Hartford Township.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve a one year Set-Up license for Knotty Pine Ballroom in Hartford Township at the address of 30509 U.S. 71, Browerville, MN.

On motion by Neumann and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve a one year On Sale, Off Sale, and Sunday Liquor License for Rhodes Midway Gas Bar & Grill Inc at the address of 17908 US 71, Long Prairie, MN in Round Prairie Township.

On motion by Neumann and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote:

GAMBLING PERMIT FOR SAUK CENTRE FIRE RELIEF ASSOCIATION 

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Sauk Centre Fire Relief Association through this resolution. RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for Sauk Centre Fire Relief Association to hold gambling activities at T.J.’s on Diamond Point Inc. in Birchdale Township at the address 12867 Bayview Drive, Sauk Centre, MN effective April 1, 2016 for 1 year.

On motion by Neumann and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote:

GAMBLING PERMIT FOR SOCIETY OF SAINT PIUS X 

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Society of Saint Pius X; Long Prairie, MN Inc. through this resolution. RESOLVED, that the Todd County Board of Commissioners approve a one day Gambling Permit for the Society of Saint Pius X; Long Prairie, MN Inc. to hold a raffle at the St John Vianney Church in Round Prairie Township at the address 18910 Ellipse Loop, Long Prairie, MN on August 7, 2016.

Recorder’s Office

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the request: issue a $990 check from the general fund to the Todd County Recorder to be deposited into checking account 40-264 to increase this account minimum balance from $10 to $1,000 and allow credit card payment option to cover drivers’ license services provided by the Recorder/Registrar’s office.      

Planning & Zoning

On motion by Kneisl and seconded by Erickson, the following Zoning Amendment request was introduced and adopted by unanimous vote: To approve the Zoning Amendment request to change the zoning district of the SE4 of the SW4 of Section 25, Eagle Valley Township from AF-1 to AF-2 for the purpose of allowing the existing dwelling to be moved to another location on this property. Owners: Derek Schumann, Steven and Donna Hinzmann. Site Address: 34195 Co 89, Browerville, MN 56378. Granted with no conditions or changes or reasons.          

On motion by Neumann and seconded by Kneisl, the following Re-zoning request was introduced and adopted by unanimous vote: Zoning Amendment request to change the zoning district of the W2 of the NW4 of Section 13, Villard Township from R-2 to AF-2 for the purpose of operating a feedlot. Commercial zoning district to remain. Owners: Shawn Jordahl. Site Address: 33249 Spruce Rd, Motley, MN 56466. Granted without any conditions, changes or reasons. 

On motion by Erickson and seconded by Kneisl, opposed by Kircher. The following request was introduced and was tabled: To deny the Conditional Use Permit request for a riding stable. Site to be used as a destination for Circle R Ranch groups to hitch their horses for watering and for the children to change into their swimsuits. Owner: Jack McCoy. Site Address: 20984 331st Avenue, Swanville. Topic will be brought back to the next Commissioner Meeting April 4, 2016.

On motion by Neumann and seconded by Erickson, the following preliminary plat request was introduced and adopted by unanimous vote: To approve Subdivision request for the preliminary plat named “SEIDE ADDITION” containing three residential lots and three outlots located on Osakis Lake along County Rd. 55. Owners: Justin Seide and Steven Seide. Site Address: 17660 Lake St E, Osakis. Granted without any conditions, changes or reasons.             

On motion by Kircher and seconded by Erickson, the following preliminary plat request was introduced and adopted by unanimous vote: To approve Subdivision request for the preliminary plat named “Maple Hill” containing two residential lots located on Big Swan Lake along Duckweed Dr. Owner: Darrell Bacon, Gary Messerich. Granted with the following to be included: This site is located in an agricultural district, and consequently there will be from time to time, sights, sounds and smells associated with the operation of farming. No lot owner shall bring action of Law, against any farming operation because of such farming activities, as long as such farming activity complies with state, federal, EPA or Todd County Ordinances.”

Soil & Water Conservation

On motion by Neumann and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve agreement to enter into a contract with Sauk River Watershed District, Big Birch Lake Association, and Water Guards, for services outlined in the contracts.

Ditch & Ag

On motion by Kneisl and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote: 

HOLD HARMLESS AGREEMENT FOR DITCH/SPOIL 

MAINTENANCE – COUNTY DITCH 15 

WHEREAS, Lance Grewe is requesting to maintain old spoils on approximately 2,254 feet of Lateral 4 and to maintain approximately 1,000 feet of ditch in the same section on CD15. This ditch line is located on his property in Stowe Prairie Twp Section 26 on parcel numbers 23-0022300 and 23-0022401, and;

WHEREAS, a Hold Harmless Agreement has been submitted to the Ditch Authority and a Wetland Application has been submitted to the TEP. 

RESOLVED, the Todd County Ditch Authority gives permission to Lance Grewe to maintain old spoils on approximately 2,254 feet of Lateral 4 and to maintain approximately 1,000 feet of ditch on the same section on CD15, located on his own property, at his own expense.

Public Works

On motion by Kircher and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote: 

FINAL PAYMENT 

AUTHORIZATION - 2014 BRIDGE CONSTRUCTION CONTRACT 

WHEREAS, the contract with Riley Brothers Construction, Inc. for the 2014 Bridge Construction Contract known as SAP 077-597-004, SAP 077-598-025, SAP 077-598-026, SAP 077-598-027 and SAP 077-599-063 located in various locations in Todd County, has in all things been completed. RESOLVED, that the Board of Commissioners does here accept said completed project for and in behalf of the County of Todd and authorize final payment as specified.

Assessor’s Office

On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: The County Board hereby sets the Todd County Board of Appeal and Equalization meeting for June 20, 2016, commencing at 6:00 p.m. and not ending before 7:00 p.m.

Emergency Management 

On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve MOA between Todd County EM and DHS – IPAWS.

Sheriff’s Department

Discussion was held regarding rescinding BA Tracking #20151215-24, no action was taken.

Auditor-Treasurer Report

Nothing at this time.

Commissioners’ Report

The Commissioners reported on the meetings they had attended.
