Public Comment
Charles Anderson , Kandota Landing CUP applicant, provided further information regarding his CUP request for the board’s consideration.
Call to Order
The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 15th day of August, 2023 at 9 a.m. The meeting was called to order by Chairperson Neumann. The meeting was opened with the Pledge of Allegiance. All Commissioners were present with Commissioner Noska attending remotely via interactive technology due to schedule conflicts.

APPOINTMENT OF BONNIE THOELE TO THE HOUSING AND REDEVELOPMENT AUTHORITY BOARD OF TODD COUNTY
WHEREAS, the Todd County Board of Commissioners of Todd County, Minnesota held a duly authorized special meeting on the 12th day of September, 1972; and
WHEREAS, at said meeting a resolution was passed and adopted declaring the need for a Housing and Redevelopment Authority in Todd County, Minnesota; and
WHEREAS, the term for District 1 is set to expire on September 18, 2028 on the Todd County HRA Board and Bonnie Thoele has expressed her desire for reappointment to this position.
NOW, THEREFORE BE IT RESOLVED, pursuant to the provisions of the Municipal Housing and Redevelopment Act of the State of Minnesota, the County Board of Commissioners of Todd County, Minnesota, hereby appoint the person hereinafter named to serve as Commissioner of the Housing and Redevelopment Authority of Todd County, Minnesota, and to serve for the remainder of the period of five years as hereinafter stipulated: Bonnie Thoele – September 19, 2023 through September 18, 2028.
Discussion of the appointment of Verna Toenyan for HRA-District 5 to determine eligibility to maintain compliance with statute requirements and avoid conflict of interest will be looked into.

TRANSFER OF FUNDS FROM COUNTY DITCH FUND TO
GENERAL REVENUE FUND
WHEREAS, The County Ditch Authority has approved to have the hours worked by the County Ditch Inspector charged back to that ditch, and;
WHEREAS, the calculations have been made for the County Ditch Inspector’s time for the period of July 1, 2022 through June 30, 2023 per attached copy;
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve the transfer of $5,460.00 from the Fund 40-County Ditch Fund to the Fund 01-General Revenue Fund per the attached list.
Public Works

Announced that the 2024 CSAH 14 Bridge Project Funding Award letter has been received so this planned construction project can move forward with state funding support.

2023 Pavement Marking
Maintenance Contract
WHEREAS, the contract with Sir Lines-A-Lot, LLC for the 2023 Pavement Marking Maintenance Contract known as CP 77-23-03 located on various routes in Todd County, has in all things been completed, and;
WHEREAS, construction work on this contract was scheduled and completed in 2023 with the value of the total work certified being $138,315.45, and;
WHEREAS, partial payments amounting to $131,299.93 have been previously been made to the contractor as work progressed, and;
WHEREAS, it has been determined that $7,015.52 still remains to be paid to Sir Lines-A-Lot, LLC.
NOW, THEREFORE BE IT RESOLVED, that the Board of Commissioners does here accept said completed project for and in behalf of the County of Todd and authorize final payment as specified.

On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous vote: To reduce the 2023 estimated market value of parcel 36-0129500 from $555,700 to $22,600.
On motion by Denny and second by Becker, the following motion was introduced and adopted by unanimous vote: To reduce the 2022 estimated market value of parcel 36-0111200 from $242,200 to $83,300 resulting in a property tax reduction of $2,222 in 2023.
Ditch/Ag Inspector
On motion by Denny and second by Becker, the following resolution was introduced and adopted by unanimous vote:
Hold Harmless Agreement – Ditch Maintenance – County Ditch 29
WHEREAS, Tyler Becker is requesting to maintain approximately 1,531 feet of CD29 that is located on his parcel 07-0028600. A Hold Harmless Agreement has been signed and submitted to the Ditch Authority, and;
WHEREAS, an onsite inspection has been done, and;
WHEREAS, applicant is allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation. Spoil must be side cast and leveled, staying within 16.5 feet of the ditch, or moved to an approved upland site. If the section of ditch in the County Road 20 road ROW is cleaned, the spoil must be moved to an approved upland site.
NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Tyler Becker to maintain approximately 1,531 feet of CD29 that is located on his parcel 07-0028600, Eagle Valley Twp section 24. Tyler Becker will do this project at his own expense.

Lori Vrolson, Central MN Council On Aging provided an update of activities and services provided to the residents of Todd County and initiatives for the future.

On motion by Denny and second by Becker, the following motion was introduced and adopted by unanimous roll call vote: To approve the bid from F-M Forklift for $40,549.00.
On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous roll call vote: To approve the purchase of the Grapple Bucket from Ziegler Cat for $29,394.00.
Planning & Zoning
On motion by Denny and second by Becker, the following motion was introduced and adopted by unanimous roll call vote: To grant the application for a six site commercial planned unit development on parcel 17-0039701 with the following conditions:
1. Placement of RVs in each campsite shall respect all property boundary setbacks.
2. Planned Unit Development is capped at six campsites as requested in the application. Additional campsites shall require the review of the Planning Commission.
3. Applicant must abide by all other applicable federal, state, and local standards.
4. Protective covenants shall be recorded to the property upon approval of the application.
5. Holding tank for sewage treatment shall be installed prior to placement of campers. Hook up sites for each campsite shall be installed at the time of tank installation.

Administration
Discussion was held regarding the Minnesota Legislature’s recent passage of the adult-use cannabis bill and whether to consider an ordinance regulating use of cannabis and cannabis derived products in public places.
On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous roll call vote: To set a Cannabis Ordinance public hearing for September 19, 2023 and a second reading public hearing on October 17, 2023 to begin at 9:15 a.m. in the County Commissioners Board Room and instruct all appropriate legal notices to be generated and published accordingly.
On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous roll call vote: to renew the LPHA Lease Agreement with the presented terms and conditions.
On motion by Becker and second by Denny, the following resolution was introduced and adopted by unanimous roll call vote:
Set 2024 Non-Union Employee/Appointed Officials Salaries
WHEREAS, the Todd County Board of Commissioners are responsible for setting the compensation of county employees, elected officials, appointed officials and board members, and;
WHEREAS, the Todd County Board of Commissioners desire to follow the same pattern bargained with unions for the non-union county employees and appointed officials, and;
WHEREAS, the agreements include a 2.5% general increase effective the first full pay period worked in January, 2024, pay date¬ February 7, 2024, and a 3% step increase effective the first full pay period worked in July, 2024, pay date August 7, 2024, for eligible staff. Staff currently over the maximum of the salary grid shall receive a 1.25% (one-half general increase) effective the first full pay period worked in January, 2024 pay date February 7, 2024 in accordance with county policy. There currently are no staff over the maximum of the salary grid.
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners authorize a 2.5% general increase effective the first full pay period worked in January, 2024, pay date February 7, 2024 and a 3% step increase effective the first full pay period worked in July 2024, and pay date August 7, 2024 for eligible staff. WHEREAS, the Todd County Board of Commissioners is responsible for setting compensation of county employees, elected officials, appointed officials and board members, and;
WHEREAS, the Todd County Board of Commissioners considered the duties and responsibilities of each individual position; and
WHEREAS, the Todd County Board of Commissioners considered the salaries of elected officials in other comparable counties; and
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve setting the County Commissioners salary at $35,084 plus $2,000 supplemental pay for Board Chair and $2,000 supplemental pay for the Board Vice-Chair in 2024.

WHEREAS, the Todd County Board of Commissioners is responsible for setting compensation of county employees, elected officials, appointed officials and board members, and;
WHEREAS, the Todd County Board of Commissioners considered the duties and responsibilities of each individual position; and
WHEREAS, the Todd County Board of Commissioners considered the salaries of elected officials in other comparable counties; and
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve setting the County Attorney salary at $132,950 in 2024.

TREASURER SALARY
WHEREAS, the Todd County Board of Commissioners is responsible for setting compensation of county employees, elected officials, appointed officials and board members, and;
WHEREAS, the Todd County Board of Commissioners considered the duties and responsibilities of each individual position; and
WHEREAS, the Todd County Board of Commissioners considered the salaries of elected officials in other comparable counties; and
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve setting the County Auditor/Treasurer salary at $106,725 in 2024.

County Auditor-Treasurer’s Report
The County Auditor-Treasurer reported on the final canvassed results from the County Special Primary Election with Bob Byers and Bob Kunz moving forward to the November 7, 2023 Special General Election. Results of the Upsala School District ballot question results. A reminder that any election administration questions should be directed to the A/T Office to avoid liability and miscommunication issues from surfacing. Mobile Home taxes are due on August 31, 2023.
County Attorney’s Report
The County Attorney thanked the board for considering replacement of the recent vacancy within the office.

The Commissioners reported on meetings and events attended.
Commissioner Becker attended the Finance, Cannabis, Wellness, Public Health, Dept Head, Solid Waste, SWCD, Rainbow Rider, TWCC and Hilltop Kitchen meetings.
Commissioner Denny attended the Hilltop Kitchen, Solid Waste Biannual Meeting, Economic Development, and Election Canvassing Board.
