Notice is hereby given, that a Request for Quotes for the Wadena County Friendly Rider will be received until 4:00 p.m. on Monday, November 22, 2021 for Calendar Year 2022 Corrective/Preventative Maintenance including: Tires and Discounted Fuel, Diesel and Gas. Packet including Quotes and Specifications shall be obtained from the office of the Friendly Rider, 229 Harry Rich Drive, Wadena, Minnesota  56482.

An aeration system will be in operation, shoreline of Lake Shamineau, Lot #14 of Hought’s Outlots from ice cover 2021 to ice out 2022. Purpose: to pre-vent shoreline and structure damage due to ice expansion. Be aware of open water or thin ice.

Public Comment

Delmar Smieja addressed the County Board regarding concerns on the proposed Daniel Waldoch CUP on this meeting’s agenda for approval.

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 21st day of September, 2021 at 9:00 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners were present with Commissioner Neumann absent.

Approval of Agenda

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the agenda as presented.

Consent Agenda

On motion by Kircher and seconded by Kneisl, the following motions were introduced and adopted by unanimous vote:

To approve the Todd County Board of Commissioner’s Meeting Minutes for Sept. 7, 2021 as presented.

To approve the resignation of Katie Nelson, Eligibility Worker, effective Sept. 20, 2021.

To hire Brian Thorstad, FT Road Deputy, start date 10/13/2021.

To hire Allyssa Engfer, FT Road Deputy, start date 10/05/2021.

To approve the hiring of Kevin Brown as Resource Conservationist-Riparian focus.

Auditor-Treasurer

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the Commissioner Warrants number (ACH) 401461 through 401498 in the amount of $25,967.51 and (Regular) 55191 through 55237 in the amount of $104,081.54 for a total of $130,049.05.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the Health & Human Services Commissioner Warrants number (ACH) 801970 through 802039 and (Regular) 708158 through 708229 for a total amount of $105,965.77.

On motion by Kneisl and seconded by Kircher, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the Health & Human Services SSIS Warrants number (ACH) 600464 through 600473 and (Regular) 516522 through 516550 for a total amount of $59,839.19.

On motion by Kneisl and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To reschedule the December 7, 2021 Todd County Commissioners Board Meeting to the date of Friday, December 10, 2021 at 9:00 a.m.

On motion by Erickson and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote:

TRANSFER OF FUNDS - SOUTH COUNTRY HEALTH ALLIANCE FUNDS

WHEREAS, Todd County became a member of the South Country Health Alliance on January 1, 2007, and;

WHEREAS, Todd County provided capital payments as part of our participation in this joint powers agreement, and;

WHEREAS, the Todd County Board of Commissioners resolved to withdraw from the South Country Health Alliance Joint Powers Agreement via BA#20190319-19 to be effective December 31, 2019 at 11:59 p.m., and;

WHEREAS, the seconded installment payment of Todd County’s capital has been receipted into the Human Services and Community Health Funds per audit standards.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby authorize the transfer of funds in the amount of $337,718.08 from Fund 11-Human Services and $265,349.92 from Fund 21-Community Health for a total of $603,068 to Fund 01-General Revenue to assist with the budgetary essentials of the County.

Public Works

Information regarding the 2022 CSAH 21 Bridge Project Funding Award was provided for review.

The County Board was provided information regarding the Federal Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) Funding which is being made available to Todd County Public Works with the consensus that these funds will be directed toward County Road Maintenance qualifying expenses.

County Ditch/Ag Inspector

On motion by Erickson and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote: 

Hold Harmless 

Agreement - Ditch 

Maintenance - 

County Ditch 33

WHEREAS, Richard Zunker is requesting to maintain approximately 1,320 feet of CD33 that is located on his property. A Hold Harmless Agreement has been signed and submitted to the Ditch Authority, and;

WHEREAS, an onsite inspection has been done, and;

WHEREAS, applicant is allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation. Spoil must be side cast and leveled, staying within 16.5 feet of the ditch. 

NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Richard Zunker to maintain approximately 1320 feet of CD33 that is located on his property, parcel 20-0036800, Reynolds Twp Section 33. This maintenance will be done at his own expense.

On motion by Kircher and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote:

County Ditch 19

WHEREAS, Prairie Lakes Farm LLC/Amthor Cattle is requesting to maintain approximately 1700 feet of CD19 that is located on their property. A Hold Harmless Agreement has been signed and submitted to the Ditch Authority, and;

WHEREAS, an onsite inspection has been done, and;

WHEREAS, applicant is allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation. Spoil must be side cast and leveled, staying within 16.5 feet of the ditch, or moved to an approved upland site. 

NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Prairie Lakes Farm LLC/Amthor Cattle to maintain approximately 1,700 feet of CD19 that is located on their property, parcel 26-0022100, Ward Twp Section 24. This maintenance will be done at their own expense.

The Todd County Board of Commissioners has received the Order Authorizing the Use of Todd County Ditch 41 as an Outlet. The Order will be reviewed by the Commissioners for accuracy of conditions approved at the Outlet Petition Hearing held on 9/14/2021.

County Sheriff

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve Joshua Nice’s employment status change from FT to PT, effective October 14, 2021.

On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve Lori Mielitz’s employment status change from FT to PT, effective October 8, 2021.

Health & Human Services

On motion by Erickson and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote: 

A RESOLUTION AUTHORIZING APPLICATION FOR MINNESOTA HOUSING AND FINANCE AGENCY FAMILY HOMELESSNESS PREVENTION AND ASSISTANCE PROGRAM

WHEREAS, the Minnesota Housing Finance Agency, State of Minnesota, has authorized to undertake a program to provide funds for Family Homelessness Prevention and Assistance Projects; and;

WHEREAS, Lutheran Social Service has developed an application for the Minnesota Housing Finance Agency Family Homelessness Prevention and Assistance Program; and;

WHEREAS, Lutheran Social Service has demonstrated the ability to perform the required activities of the Minnesota Housing Finance Agency Family Homelessness Prevention and Assistance Program.

NOW, THEREFORE BE IT RESOLVED, that Lutheran Social Service is hereby authorized as an entity to be charged with the administration of funds made available through the Minnesota Housing Finance Agency Family Homelessness Prevention and Assistance Program in the county of Todd, in Minnesota.

Solid Waste

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the use of ARP/CSLFRF funds to continue Doherty temp staff at Solid Waste (when eligible). Approve increase in Doherty Compensation from $12 to $15/hour for direct payroll cost.

Planning & Zoning

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To grant a 60 day extension to the application decision period for a CUP on parcel 18-0034700 from Jason Ehnes to allow for additional review.

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To grant a 60 day extension to the application decision period for a CUP on parcel 20-0001700 from Moses Borntrager to allow for additional review.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To grant the preliminary plat for Greystone First Addition with two conditions.

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To grant the preliminary plat for Maple Views with the six conditions.

On motion by Kneisl and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To grant the rezoning of parcel 22-0000100 with no conditions.

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To grant the conditional use permit by CHS, Inc. on parcel 21-0007100 to establish a 6,500 gallon diesel fuel bulk storage tank with one condition.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To grant the Conditional Use Permit by Daniel Waldoch to establish a custom wood working shop on parcel 24-0041800 with two conditions.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To grant the Conditional Use Permit by Moses Borntrager to establish a sawmill/wood processing facility on parcel 20-0001700 with six conditions.

Closed Session

Chair Becker closed the session at 9:58 a.m. pursuant to MN Statute §13D.03 to consider strategies for labor negotiations.

The County Coordinator reported on meetings attended including the AMC Conference.

The Commissioners were reminded of the Annual Township Meeting September 22, 2021 at 6 p.m. at the Clarissa Ballroom and that notice has been posted for their potential attendance.
