Public Comment

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 6th day of February, 2024 at 9:00 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Noska and second by Neumann, the following motion was introduced and adopted by unanimous vote: To adopt the agenda as presented with the addition of item 5.7 Discipline Designee.

Consent Agenda

On motion by Byers and second by Denny, the following motions and resolutions were introduced and adopted by unanimous vote:

To approve the Todd County Board of Commissioner’s Meeting Minutes for January 16 and 29, 2024 as presented.

GAMBLING PERMIT – ST MARY OF MT CARMEL PARISH

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the St. Mary of Mt Carmel Parish through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the St. Mary of Mt Carmel Parish to hold a raffle event at the Hub Supper Club in Burnhamville Township at the address 30905 County 13, Burtrum, MN on April 27, 2024.

GAMBLING PERMIT – SAUK CENTRE AREA CHAMBER OF COMMERCE

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Sauk Centre Area Chamber of Commerce through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Sauk Centre Area Chamber of Commerce to hold a raffle event at the Howard & Katherine Marthaler Shed in Kandota Township at the address 10098 County 11, Sauk Centre, MN on April 27th, 2024.

GAMBLING PERMIT – SAUK VALLEY GOBBLERS

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Sauk Valley Gobblers through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Sauk Valley Gobblers to hold a raffle event at Diamond Point in Birchdale Township at the address 12867 Bayview Dr, Sauk Centre, MN on April 20, 2024.

GAMBLING PERMIT – MIDWEST OUTDOORS UNLIMITED – PRAIRIE PARTNERS CHAPTER

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Midwest Outdoors Unlimited – Prairie Partners Chapter through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Midwest Outdoors Unlimited - Prairie Partners Chapter to hold a bingo event at Shady’s Golden Eagle in Grey Eagle Township at the address 13218 County 103, Grey Eagle, MN on April 7, 2024.

GAMBLING PERMIT – SAUK CENTRE FAIRY LAKE ASSOCIATION

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Sauk Centre Fairy Lake Association through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Sauk Centre Fairy Lake Association to hold a raffle event at the Lions Fairy Lake Association in Kandota Township at the address 10500 County 95, Sauk Centre, MN on May 22nd, 2024.

To approve a one day On Sale Temporary Liquor License for the Sauk Centre Area Chamber of Commerce at the Marthaler’s Shed at the address of 10098 County 11, Sauk Centre, MN in Kandota Township effective April 27, 2024.

To approve Brian Hollenkamp to fill the open Senior Engineering Technician position at Grade 12 - Step 8 at $38.78/hour with a start date of 02/21/2024.

Auditor-Treasurer

On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous rollcall vote: To approve the January 2024 Auditor Warrants number (ACH) 903774 through 903887 in the amount of $2,030,916.58 (Manual) 908 through 916 in the amount of $85,991.21 and (Regular) 242045 through 242254 in the amount of $835,427.19 for a total of $2,952,334.98.

On motion by Noska and second by Byers, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Commissioner Warrants number (ACH) 403007 through 403039 in the amount of $74,147.15 and (Regular) 57697 through 57738 in the amount of $39,314.65 for a total of $113,461.80.

On motion by Neumann and second by Denny, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Health & Human Services Commissioner Warrants number (ACH) 804974 through 805010 and (Regular) 711491 through 711554 for a total of $83,810.46.

On motion by Denny and second by Byers, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Health & Human Services SSIS Warrants number (ACH) 601158 through 601169 and (Regular) 517681 through 517700 for a total amount of $161,679.33.

On motion by Noska and second by Denny, the following resolution was introduced and adopted by unanimous vote:

Resolution of Reconveyance of Forfeited Lands from the City of Bertha to the State of Minnesota

WHEREAS, the City of Bertha had acquired parcel 29-0003201, to utilize for the purpose of public service facilities which would follow the definition of authorized public uses in Minnesota Statute 282.01. The City of Bertha after acquiring this property has found the costs too high to use this parcel as location for public service facilities. The City of Bertha would like to reconvey this property back to the State of Minnesota. 

WHEREAS, Minnesota Statute 282.01 Subd 1a paragraph a (2) authorizes the proper offices to convey the land, or the part of the land not required to an authorized public use.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners recommends that this resolution of request to reconvey tax forfeited lands back to the State of Minnesota be granted and will be included on the next tax forfeited land sale. 

On motion by Denny and second by Neumann, the following resolution was introduced and adopted by unanimous vote:

A RESOLUTION RESTRICTING FUND BALANCE FOR CLEAN 

WATER PARTNERSHIP (CWP) LOAN PROGRAM

WHEREAS, the Todd County Board of Commissioners on February 4, 2020 (Board Tracking # 20200204-18) approved for the Todd County Planning and Zoning Department to apply for a Clean Water Partnership Loan for septic systems via the MPCA and;

WHEREAS, On February 19, 2020, Planning and Zoning received notification from the MPCA that their application for $450,000 was awarded, and;

WHEREAS, On March 4, 2020, Planning and Zoning received the executed grant agreement for the Clean Water Partnership (CWP) Loan Program and;

WHEREAS, On April 21, 2020, the Todd County Board of Commissioners approved the Clean Water Partnership Loan General Obligation Note (Board Tracking #20200421-18), and;

WHEREAS, On January 18, 2022 the Todd County Board of Commissioners approved the establishment of a Restricted Fund Balance for Clean Water Partnership (CWP) Loan Program with a balance of $6,676.90 as of 12-31-2021. (Board Tracking #20220118-13), and;

WHEREAS, On January 17, 2023, the Todd County Board of Commissioners approved the establishment of a Restricted Fund Balance for Clean Water Partnership (CWP) Loan Program with a balance of $30,933.19 as of 12-31-2022. (Board Tracking #20230117-10), and;

WHEREAS, Planning and Zoning collects application fees, annual principle and interest to supply for the loan repayment to MPCA and;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby authorize the County Auditor/Treasurer to update the Restricted Fund Balance for the Clean Water Partnership (CWP) Loan Program account in Fund 01-613 with a balance of $81,462.36 as of 12-31-2023.

On motion by Neumann and second by Noska, the following motion was introduced and adopted by unanimous vote: To appoint the Personnel Committee as the designee to carry out all disciplinary measures, with the exception of dismissal pending County Coordinator start date.

County Assessor

On motion by Byers and second by Denny, the following motion was introduced and adopted by unanimous vote: The Todd County Board hereby schedules the 2024 Todd County Board of Appeal and Equalization meeting for June 18, 2024; commencing at 6:00pm and not ending before 7:00 p.m.

Ditch/Ag Inspector

On motion by Noska and second by Byers, the following resolution was introduced and adopted by unanimous vote: 

HOLD HARMLESS AGREEMENT – DITCH MAINTENANCE – COUNTY DITCH 32

WHEREAS, Doug Carry, acting on behalf of the owners of four parcels, is requesting to maintain approximately 3,900 feet of County Ditch 32 that is located on these four properties. This footage is part of Lateral 3, and Branch 5 of Lateral 3, that is located on parcels 24-0008700, 24-0008800, 24-0009700 and 24-0009800. A Hold Harmless Agreement has been signed by all landowners and submitted to the Ditch Authority, and;

WHEREAS, an onsite inspection has been done, and;

WHEREAS, applicants are allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation.  Spoil must be side cast and leveled, staying within 16.5 feet of the ditch or moved to an approved upland site. 

NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Doug Carry, acting on behalf of the owners of four parcels which are listed above, to maintain approximately 3,900 feet of Lateral 3, and Branch 5 of Lateral 3, on CD32, Turtle Creek Twp sections 8 & 9. This maintenance will be done on their own properties and at their own expense.

MIS

On motion by Neumann and second by Noska, the following motion was introduced and adopted by unanimous vote: To approve hosting the Todd County website with Revize with the option to pay over 5 years.

Public Works

On motion by Noska and second by Byers, the following motion was introduced and adopted by unanimous vote: To set the 2024 Spring Road Meeting for April 17, 2024 at 9:00 a.m. at Todd County Public Works Northern Shop.

Facilities Committee

On motion by Byers and second by Neumann, the following motion was introduced and adopted by unanimous vote: Authorize the Facilities Committee to move the Todd County Historic Rockwall Restoration Project forward to the public construction bid phase.

On motion by Neumann and second by Denny, the following motion was introduced and adopted by unanimous vote: To approve the attached Engineering and Architectural Services Proposal from Widseth for the Todd County Historic Rockwall Restoration Project for $32,930.

Facilities Department

On motion by Denny and second by Byers, the following motion was introduced and adopted by unanimous vote: To change the title of “Facilities Supervisor” to “Facilities Manager” to better describe the position.

Planning & Zoning

On motion by Noska and second by Denny, the following motion was introduced and adopted by majority vote with Neumann against: Adopt the findings of the Planning Commission and grant the CUP to parcel 21-0008601 with the following conditions:

1. Existing southern fence shall be moved to achieve a 50’ setback from private wells. Fence shall be setback no less than 4’ from the southern property line. 

2. Perimeter fence shall be maintained to provide sufficient screening from all public roads. Perimeter fence shall be no less than 10’ in height measured from the ground surface.

3. Perimeter fence shall be fully established no later than August 1st, 2024.

4. Applicant shall obtain MPCA Industrial Stormwater Permitting and provide verification of permitting to the County. Application shall be submitted no later than May 1, 2024.

5. Accumulation of scrap material shall not be visible from US Highway 71.

6. Applicant must abide by all applicable federal, state, and local standards.

7. County shall conduct a site review on August 2, 2024 to verify conditions.

On motion by Denny and second by Byers, the following resolution was introduced and adopted by unanimous vote:

Final Plat Approval – “Sales Estates” Subdivision 

WHEREAS, Applicants and property owners Bruce & Christine Sales applied to subdivide a property that is described as part of Section 22 of Burnhamville Township with the plat to be known as “Sales Estates”,

WHEREAS, Sales Estates consists of one lot; Block 1, Lot 1, 4.68± acres, located in Shoreland Natural Environment Zoning District in Burnhamville Township,

WHEREAS, On November 2, 2023, the Todd County Planning Commission recommended the following property be considered for Subdivision pursuant to Todd County Subdivision Regulation and Ordinance:  

That part of the Northeast Quarter of the Northwest Quarter, Section 22, Township 128, Range 32, Todd County, Minnesota, described as follows:

Commencing at the northeast corner of said Northeast Quarter of the Northwest Quarter; thence South 00 degrees 39 minutes 54 seconds West, assumed bearing, 399.50 feet along the east line of said Northeast Quarter of the Northwest Quarter to the point of beginning; thence North 89 degrees 20 minutes 06 seconds West 505.00 feet; thence North 00 degrees 39 minutes 54 seconds East 407.57 feet to the intersection with the north line of said Northeast Quarter of the Northwest Quarter; thence South 88 degrees 25 minutes 09 seconds East 505.06 feet along said north line of the Northeast Quarter of the Northwest Quarter to the point of beginning.

An easement for ingress, egress, and utility purposes, over, under, and across that part of the Northeast Quarter of the Northwest Quarter, Section 22, Township 128, Range 32, Todd County, Minnesota, described as follows:

Commencing at the northeast corner of said Northeast Quarter of the Northwest Quarter; thence South 00 degrees 39 minutes 54 seconds West, assumed bearing, 399.50 feet along the east line of said Northeast Quarter of the Northwest Quarter to the point of beginning of said easement to be described; thence North 89 degrees 20 minutes 06 seconds West 330.00 feet; thence South 00 degrees 39 minutes 54 seconds West 33.00 feet; thence South 89 degrees 20 minutes 06 seconds East 330.00 feet to said east line of the Northeast Quarter of the Northwest Quarter; thence North 00 degrees 39 minutes 54 seconds East 33.00 feet along said east line of the Northeast Quarter of the Northwest Quarter to the point of beginning.

WHEREAS, On November 21, 2023, the Todd County Board of Commissioners considered the Preliminary Plat for the above described property and approved the Sales Estates preliminary plat with no conditions.

WHEREAS, the Planning & Zoning Department has completed the necessary final plat review and find that all items required for final plat approval have been completed. 

NOW, THEREFORE BE IT RESOLVED, the final plat of “Sales Estates” be approved as presented.

Information was provided to the County Board regarding Planning & Zoning with the support of Health & Human Services and SWCD intend to apply for grant funding to assist private well users with safe drinking water.

Soil and Water

On motion by Denny and second by Byers, the following motion was introduced and adopted by majority vote with Neumann against: To approve and support to authorize the SWCD to apply for grant funding in pursuit of funding to support a position via the Soil Health Grant.

Health & Human Services

On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote: To authorize the hiring of one Care Coordinator.

On motion by Denny and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the ARPA funding request in the amount of $7,000 for a portion of a new convection oven purchase at Hilltop Regional Kitchen.

On motion by Byers and second by Noska, the following motion was introduced and adopted by unanimous vote: To approve the Opioid Settlement funding request of $6,500 for the support of the Long Prairie Police Department’s DARE education program.

On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote: To approve the Opioid Settlement funding request of $15,000 for lodging, transportation and TIDA supports.

Commissioners

On motion by Neumann and second by Byers, the following resolution was introduced and adopted by unanimous vote: 

RESOLUTION IN OPPOSITION TO REDESIGNING THE STATE FLAG AND SEAL

WHEREAS, the 2023 Legislature created a State Emblems Redesign Commission in the Laws of Minnesota , Chapter 62, Article 2, Section 118 the purpose of which is to redesign the official state flag and official state seal; and,

WHEREAS, the Redesign Commission was charged with bringing recommendations on the redesign to the Legislature by no later than January 1, 2024; and,

WHEREAS, the official seal of the State of Minnesota has remained unchanged since 1858; the current official state flag was created in 1957 with minor modifications done in 1983; and,

WHEREAS, the official state flag and seal are not only symbols of our state, but also of our history and both the current official state flag and official state seal contain historical information on our farming background, Native American heritage and the co-existence that is part of the rich history of our state; and,

WHEREAS, there is a substantial public cost associated with making this change that does not advance the public interest, including every deputy badge, seals in every courtroom and County Board Rooms across the state at substantial public expense; and,

WHEREAS, the public reaction to the proposed designs has thus far been overwhelmingly negative,

THEREFORE, BE IT RESOLVED, the Todd County Board of Commissioners hereby urges our legislative delegation and the Governor to reject the work of the State Emblems Redesign Commission; and,

BE IT FURTHER RESOLVED, the Todd County Board of Commissioners hereby urges our legislative delegation and the Governor to retain the existing state seal and state flag as the official emblems for the State of Minnesota.

On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous vote: To approve letter of support for CTC USDA Community Connect Grant application.

On motion by Noska and second by Byers, the following motion was introduced and adopted by unanimous vote: To approve financial support of $5,000 for CTC for USDA Community Connect Grant, if grant is awarded.

On motion by Denny and second by Neumann, the following motion was introduced and adopted by unanimous vote: Approve Letter of Support for Nelson Park Splashpad in the City of Eagle Bend.

On motion by Neumann and second by Byers, the following motion was introduced and adopted by unanimous vote: To approve the Board Chairperson to sign the letter of intent to submit for the PLSS Monument Grant Application.

On motion by Neumann and second by Noska, the following motion was introduced and adopted by unanimous vote: Approve interim change to move GIS under SWCD/PZ reporting to the SWCD/PZ Director, until a final decision is made.

On motion by Neumann and second by Denny, the following motion was introduced and adopted by unanimous vote: To approve the terms of the Employment Agreement for the County Coordinator with a start date of 3/11/2024.

County Auditor-Treasurer’s Report

The County Auditor-Treasurer reported that the office remains steady with audit and election preparations.

County Attorney’s Report

The County Attorney is back at full strength with staffing.

County Commissioner’s Report

The Commissioners reported on meetings and events attended.

Commissioner Denny attended regular monthly meetings.

Commissioner Becker attended the West Central Reg. Juvenile, TWCC, Extension, Planning & Zoning, Facilities and Public Health Advisory meetings.

Commissioner Noska attended regular monthly meetings and noted that the Winter Demo Derby was a well-attended event.

Commissioner Neumann attended the SRWD, CPT, Finance Committee, Personnel, Surveyor, CMCOA, Public Health Advisory meetings.

Commissioner Byers attended the AIS, Wellness, Planning & Zoning, Facilities, and Wellness meetings.

Chairperson Becker recessed the meeting until February 20, 2024.
