OUTLET PETITION - HEARING NOTIFICATION

 

A Public Hearing will be held Tuesday June 29, 2021 at 7 p.m. It will be held at the Todd County Expo Building located at the Todd County Fairgrounds, 203 9th St NE, Long Prairie, MN 56347. This Public Hearing is regarding a Petition that has been submitted by the LSLID requesting to use County Ditch 41 as an outlet for their High-Water Outlet Project. All interested landowners are welcome and encouraged to attend this Informational Meeting. Commissioners Becker, Erickson, Neumann, Kneisl, Kircher, Attorney Kurt Deter and CDI Nancy Uhlenkamp will be in attendance for Todd County. The LSLID representatives, Attorney, and Engineer will be in attendance for the LSLID. 

Landowners can join the meeting in the following ways.

The Todd County Soil and Water Board of Supervisors will be hosting and attending a car and foot tour of recent projects/activities in the Staples/Villard Township areas along the Long Prairie River and a NRCS Local Work Group Meeting on June 9, 2021. Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 6th day of April, 2021 at 9:00 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Neumann and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the agenda as presented.

WHEREAS, the Todd County Development Corporation has provided assistance to Todd County with the administration of the County Relief Grant Program, and;

WHEREAS, the County Board desires to allocate a portion of the administrative funds from the County General Fund to the Todd County Development Corporation for their services on this program.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby approve the transfer of funds in the amount of $4,818.36 from Fund 01-General Revenue to Fund 74-Todd County Development Corporation.

Hands of Hope Resource Center

On motion by Kneisl and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote: 

April 2021 

Sexual Assault Awareness Month Proclamation

WHEREAS, Hands of Hope Resource Center in conjunction with the Todd County Board of Commissioners are dedicated to making and keeping our county and its communities a safe and welcoming area for all families, and; 

WHEREAS, the voices of those who have been victimized by sexual assault need to be heard, and a clear message sent that there is no disgrace in being a survivor of sexual violence, as that shame lies only with the aggressor, and;

WHEREAS, Hands of Hope Resource Center continues to advocate and support multiple victims of all ages of sexual assault, through personal advocacy, court and systems advocacy, referrals to other needed services, and by providing a caring, non-judgmental, and confidential space with respectful and knowledgeable individual advocates to assist them, and; 

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners joins Hands of Hope Resource Center in supporting and encouraging residents of Todd County to become part of the solution to eliminate sexual violence and to support and empower survivors. The first step in prevention is increased education, awareness and community involvement. We all need to speak out against harmful attitudes and actions, as well as holding perpetrators of sexual violence accountable for these life-altering crimes and;

BE IT FURTHER RESOLVED, that the Todd County Board of Commissioners does hereby proclaim April 2021 as Sexual Assault Awareness Month and encourages constituents to join those who work to provide justice and safety in their effort to eliminate sexual violence in all communities in our county.

Ditch/Ag Inspector

On motion by Neumann and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: Acting as Todd County Ditch Authority, acknowledges receipt of an Outlet Petition from the Shamineau Lake Improvement District (LSLID) to use County Ditch 41 as an outlet for their High-Water Outlet Project. Ditch Attorney Kurt Deter has reviewed the petition and said it was a valid petition.

On motion by Erickson and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote:

Hold Harmless Agreement- Ditch Maintenance – 

County Ditch 33

WHEREAS, Pete Bosl is requesting to maintain approximately 828 feet of Lateral 1 on parcel –20-0037300. The maintenance will be done on his own property, at his own expense. A Hold Harmless Agreement has been signed and submitted to the Ditch Authority, and;

WHEREAS, in 2010 the Todd County Ditch Authority gave Pete permission to replace this section of ditch with an 8” non-perforated tile. This tile installation was never done because he determined that an 8” tile would not provide the drainage needed, and;

WHEREAS, applicant is allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation.  Spoil must be side cast and leveled, staying within 16.5 feet of the ditch.  .

NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Pete Bosl to maintain approximately 828 feet of CD33 that is located on his property, at his own expense.

Public Works

On motion by Kneisl and seconded by Kircher, the following resolution was introduced and adopted by unanimous vote: 

FOR GRANT 

AGREEMENT TO STATE TRANSPORTATION FUND (LOCAL BRIDGE REPLACEMENT 

PROGRAM) – EXIHIBIT C GRANT TERMS AND CONDITIONS FOR 

SAP 077-611-034 

WHEREAS, Todd County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Bridge #77J94, and;

WHEREAS, the Commissioner of Transportation has given notice that funding for this project is available, and;

WHEREAS, the amount of the grant has been determined to be $196,712.25 by reason of the lowest responsible bid.

NOW, THEREFORE BE IT RESOLVED, be it resolved that Todd County does hereby agree to the terms and conditions of the grant consistent with Minnesota Statutes, Section 174.50, and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for the bridge but not required. The Todd County Board Chairperson and Todd County Auditor/Treasurer are authorized to execute a grant agreement and any amendments thereto with the Commissioner of Transportation concerning the above-referenced grant.

On motion by Neumann and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To set the 2021 Spring Road Meeting for April 12, 2021 at 9:00 a.m. at the Todd County Board Room.

CONTRACT FOR 2021 GRAVEL SURFACING PROJECTS

WHEREAS, sealed bids were received on March 29, 2021 by the Todd County Public Works Director for CP 21:67, CP 21:70, CP 21:76, CP 21:78 and CP 21:89, said projects for gravel surfacing located on various County Roads in Todd County, and;

WHEREAS, the following sealed bids were received:

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners does hereby accept and award the contract for the above said construction projects to Braaten Aggregate, Inc. of Bertha, Minnesota based on their low bid of $224,312.50.

WHEREAS, sealed bids were received on March 30, 2021 by the Todd County Public Works Director for SAP 077-605-004, SP 077-612-011, SAP 077-614-020, CP 21:102, and CP 77-21-01, said projects for highway construction related work at various locations in Todd County, and;

WHEREAS, the following sealed bids were received:

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners does hereby accept and award the contract for the above said construction projects to Knife River Corporation of Sauk Rapids, Minnesota based on their low bid of $3,747,542.68, with said award being made contingent upon the contractor submitting the required EEO and DBE documents to MnDOT and subsequent approval of said documents.

Parks and Trails

On motion by Erickson and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Battle Point Restroom Remodel Project and projected expenses of $19,515.61.

County Attorney

On motion by Kircher and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote: 

RESOLUTION 

APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS WITH THE COUNTY OF TODD ON BEHALF OF ITS COUNTY ATTORNEY AND SHERIFF

WHEREAS, the County of Todd on behalf of its County Attorney and Sheriff desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State’s criminal justice data communications network for which the County is eligible. The Joint Powers Agreements further provides the County with the ability to add, modify and delete connectivity, systems and tools over the five year life of the agreement and obligates the County to pay the costs for the network connection.

NOW, THEREFORE BE IT RESOLVED, by the County Board of Todd, Minnesota as follows:

1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Todd on behalf of its County Attorney and Sheriff are hereby approved.

2. That the Sheriff, Steve Och, or his successor, is designated the Authorized Representative for the Sheriff. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County’s connection to the systems and tools offered by the State.

To assist the Authorized Representative with the administration of the agreement, Sarah Booker is appointed as the Authorized Representative’s designee.

3. That the Todd County Attorney, Charles G. Rasmussen, or his successor, is designated the Authorized Representative for the County Attorney. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County’s connection to the systems and tools offered by the State.

To assist the Authorized Representative with the administration of the agreement, Sonja Pearson is appointed as the Authorized Representative’s designee.

4. That Barbara Becker, the Chair of the County of Todd, and Denise Gaida, the County Board Clerk, are authorized to sign the State of Minnesota, Joint Powers Agreements.

County Sheriff

On motion by Kneisl and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To accept the TCPR Training Grant.

Emergency Management

On motion by Kircher and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote: 

A RESOLUTION 

AFFIRMING TODD COUNTY’S SUPPORT OF REGION V+ MULTI-USE RESPONSE AND 

COMMUNICATIONS EMERGENCY MOBILE COMMAND CENTER

WHEREAS, The Todd County Board sees the need for a Multi-Use Response and Communications command center, here on known as the MURC, to maintain communications, establish a command post, provide logistical support and improve responsiveness to all community hazards, and;

WHEREAS, modernizing the current 23-year-old mobile command center utilized in Sourcewell Region V+ and Homeland Security Emergency Management (HSEM) Region IV, and;

WHEREAS, the unpredictability of catastrophic events requires collaboration, timeliness, and the functionality of equipment to increase effectiveness and enhance preparedness to provide support to the community, and;

WHEREAS, each year we see an increase in the number of incidents, being it manmade or natural, and;

WHEREAS, Region V+ needs to increase the capability to respond in a timely manner supporting the community and public safety, and;

WHEREAS, the complexity and type of incidents are changing requiring more support, technology and equipment that the existing command center is currently unable to carry, and;

WHEREAS, Region V+ Emergency Management (Cass, Crow Wing, Morrison, Aitkin, Todd and Wadena Counties) takes pride in its responsibility to protect the community through reliable public safety entities by sustaining and maintaining standard operational procedures in times when mobility is warranted, and; 

WHEREAS, Emergency Management will develop training, exercises and standard operating procedures with Region V+ partners, to be able to support these communities and state in an all hazards response, and;

WHEREAS, the exercise will be performance measures in the capability and evaluation of MURC. 

NOW, THEREFORE BE IT RESOLVED, THAT TODD COUNTY, THROUGH THE TODD COUNTY BOARD OF COMMISSIONERS, does hereby sign on to support Emergency Management in providing the community with functional public safety assets. We resolve to, apply for funding through Sourcewell to upgrade our current mobile dispatch center to a self-sustained highly functional command center.

Health & Human Services

Jackie Och, HHS Director and Katherine Mackedanz, Community Health Manager provided an update to the County Board on the COVID-19 situation and vaccination availability.

Administration

The County Board congratulated the Todd County Health and Human Services for being named a national best practice agency by Fazzi Associates and Home Health CAHPS Patient Satisfaction 2020 Award of Distinction.

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To conduct Department Head evaluations on April 20, 2021 during the board meeting.

WHEREAS, the Todd County Board of Commissioners has recognized a need for strong, up to date personnel policy, and;

WHEREAS, the Todd County Board of Commissioners and policies subcommittee have had an opportunity to review the policy revisions put forth in Article VII, Section 7.05 of the Personnel Policy and find the implementation to be in the best interest of the sound administration of the County;

NOW, THEREFORE BE IT RESOLVED, the Todd County Board of Commissioners adopts the attached changes to the Todd County Personnel Policy and directs the County Coordinator to begin administration of said policy as of April 6, 2021 and;

BE IT FURTHER RESOLVED, that it is understood that this Resolution replaces and supersedes all prior County Board actions, oral or written, relating to the subject matter hereof.

NOW, THEREFORE BE IT RESOLVED, the Todd County Board of Commissioners adopts the attached changes to the Todd County Personnel Policy and directs the County Coordinator to begin administration of said policy as of April 6, 2021 and;

BE IT FURTHER RESOLVED, that it is understood that this Resolution replaces and supersedes all prior County Board actions, oral or written, relating to the subject matter hereof.

County Auditor-Treasurer’s Report

The County Auditor-Treasurer reported that the ISD 2170 Staples-Motley Special Election is scheduled for April 13, 2021 and that our audit via CliftonLarsonAllen was the week of March 29, 2021.

Commissioners reported on meetings attended.

County Coordinator’s Report

The County Coordinator provided an update regarding Mr. Sellnow’s assistance with fairground matters and affirmation that the Ag Society’s good standing rating with the MN Secretary of State’s office has been resolved.
