INFORMAL PROBATE OF WILL AND APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE
TO CREDITORS
Notice is given that an application for informal probate of the Decedent’s will dated December 19, 1995 (“Will”), has been filed with the Registrar. The application has been granted.
Notice is also given that the Registrar has informally appointed Jacqueline L. Midthun whose address is 500 Jewell Street, Mora, Minnesota 55051 as personal representative of the Estate of the Decedent. Any heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court (pursuant to Minnesota Statutes Section 524.3-607) and the Court otherwise orders, the personal representative has full power to administer the Estate, including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.
Any objections to the probate of the Will or appointment of the Personal Representative must be filed with this Court and will be heard by the Court after the filing of an appropriate petition and proper notice of hearing.
Notice is also given that (subject to Minnesota Statutes Section 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.
A charitable beneficiary may request notice of the probate proceedings be given to the Attorney General pursuant to Minnesota Statutes Section 501B.41, subdivision 5.

Minutes of the Meeting of the Todd County Board of
Commissioners held
MAY 21, 2024
Public Comment
Roger Hendrickson provided information to the County Board regarding the County Ditch 42 system potential repayment terms and other items for study before making decisions on the proposed project.
Maurice Durheim provided his perspective of support for the proposed County Ditch 42 system project.
Greg Warner provided his concerns to withhold support to the County Board for the Ditch 42 project.
Delvin Durheim provided information regarding perceived negative impacts if the Ditch 42 project is not supported to move forward by the County Board.
Arlene Brinkman and Bill Nietfeld expressed concerns regarding the lack of benefit of this Ditch 42 project for their property that would be assessed if approved.
Call to Order
The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 21st day of May, 2024 at 9 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners were present except Commissioner Byers.
Approval of Agenda
On motion by Noska and second by Neumann, the following motion was introduced and adopted by unanimous vote: To adopt the agenda as presented.
Consent Agenda
On motion by Denny and second by Neumann, the following motions and resolution were introduced and adopted by unanimous vote:
To approve the Todd County Board of Commissioner’s Meeting Minutes for May 7, 2024 as presented.
Approve the retirement of Mary Rae Haugen, Assistant WIC Nutritionist, effective May 31, 2024.
Approve the hiring of Mr. Nicholas Brown to fill the vacant Public Work Heavy Equipment Operator position at Grade 7, Step 1 ($23.56/hour).
To approve the hiring of Emily Olson, Solid Waste seasonal worker.
Approve the resignation of Eligibility Worker Jessica Miller effective May 29,2024.
To hire Kaitlin Welters as a full-time Deputy Auditor-Treasurer at Grade 8, Step 1 $24.97 per hour with a start date to be determined.
GAMBLING PERMIT –
Ivy’s Legacy Foundation
WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Ivy’s Legacy Foundation through this resolution;
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Ivy’s Legacy Foundation to hold a raffle event at The Shed in Kandota Township at the address 10098 County Road 11, Sauk Centre, MN on October 26, 2024.
GAMBLING PERMIT –
HOLY FAMILY SCHOOL
WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Holy Family School through this resolution;
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Holy Family School to hold a raffle event at the Diamond Point Steakhouse & Lounge in Birchdale Township at the address 12867 Bayview Drive, Sauk Centre, MN on September 7, 2024.
To approve a one day Dance License for Diamond Point at the address of 12867 Bayview Dr (fenced area on north side of building), Sauk Centre, MN in Birchdale Township effective June 8th, 2024.
Auditor-Treasurer
On motion by Neumann and second by Noska, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Commissioner Warrants number (ACH) 403215 through 403246 in the amount of $22,574.25 and (Regular) 58014 through 58066 in the amount of $187,134.11 for a total of $209,708.36.
On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Health & Human Services Commissioner Warrants number (ACH) 805345 through 805394 and (Regular) 711930 through 711988 for a total of $110,497.31.
On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Health & Human Services SSIS Warrants number (ACH) 601272 through 601301 and (Regular) 517844 through 517876 for a total amount of $163,915.29.
On motion by Neumann and second by Noska, the following motion was introduced and adopted by unanimous vote: To approve the waiver of rental fees for the Freedom and Heroes Veteran Fundraiser event at the Todd County Fairgrounds for May 31 - June 2, 2024.
Todd County Fair Board
On motion by Denny and second by Neumann, the following motion was introduced and adopted by unanimous vote: To grant the Todd County Fair Board additional access to the Todd County Fairgrounds for fair preparations the week of June 9-15, 2024 with waiving of the rental fees. Utilities reimbursement will be provided by the Todd Countv Fair Board for this additional timeframe.
Public Works
On motion by Neumann and second by Byers, the following resolution was introduced and adopted by unanimous vote:
AWARD OF CONSTRUCTION CONTRACT FOR 2024 BRIDGE CONSTRUCTION PROJECT
WHEREAS, sealed bids were received on May 14th, 2024 by the Todd County Public Works Director for SAP 077-614-022, said project for bridge construction project located on County State Aid Highway 14 over the Long Prairie River located just east of the City of Browerville, and;
WHEREAS, the following sealed bid was received:
Redstone Construction, LLC Mora, Minnesota, $1,757,748.75
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners does hereby accept and award the contract for the above said bridge construction project to Redstone Construction, LLC of Mora, Minnesota based on their low bid of $1,757,748.75.
County Ditch/Ag Inspector
After presentation of the project parameters and County Board discussion, Chair Becker tabled the proposed County Ditch 42 Tile Repair Project due to the expected petition from a landowner for property to be removed from the benefitted acres roll.
Emergency Management
On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous vote: To agree to the intent to support the Statewide Public Safety Radio Communications ARMER Equipment Grant and further approve for Todd County Emergency Management to move forward with preparations for this grant.
Planning & Zoning
On motion by Neumann and second by Denny, the following motion was introduced and adopted by unanimous vote: To adopt the findings of the Planning Commission and grant the CUP to parcel 21-0007100 with the following condition: 1. Applicant abide by all other applicable Federal, State and local standards.
On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote: To adopt the findings of the Planning Commission and grant the CUP to parcel 07-0025300 with the following conditions:
1. Outdoor storage of products shall be allowed, but shall be conducted in compliance with Section 9.01B of the Todd County Planning and Zoning Ordinance.
2. Existing structure shall be re-permitted as a Commercial structure.
3. There shall be no loading or unloading of materials within the road right of way.
4. Applicant must abide by all applicable federal, state and local standards.
On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous vote: To approve the Amendment of Condition #1 of CUP2017-001 to read as follows: Establish and maintain a single row of vegetative screening on the south, west and north sides.
On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote: To adopt the recommendation of the Planning Commission and adopt the changes to Sections 5.03, 5.05, 5.06 as presented.
On motion by Noska and second by Denny, the following resolution was introduced and adopted by unanimous vote:
RESOLUTION TO SUPPORT A MISSISSIPPI RIVER-SARTELL WATERSHED ‘ONE WATERSHED, ONE PLAN’ PROJECT
WHEREAS, the Minnesota Board of Soil and Water Resources has developed policies for coordination and development of comprehensive watershed management plans, also known as One Watershed, One Plan, consistent with Minnesota Statutes, Chapter 103B.801, Comprehensive Watershed Management Planning Program; and
WHEREAS, Minnesota Statutes, Chapter 103B.301, Comprehensive Local Water Management Act, authorizes Minnesota Counties to develop and implement a local water management plan; and
WHEREAS, Minnesota Statutes, Chapter 103C.331, subdivision 11, Comprehensive Plan, authorizes Minnesota Soil and Water Conservation Districts to develop and implement a comprehensive plan; and
WHEREAS, the counties and soil and water conservation districts within the Mississippi River-Sartell Watershed #65, as delineated in the attached One Watershed, One Plan Boundary Map, have interest in developing a comprehensive watershed management plan for this area.
NOW, THEREFORE, BE IT RESOLVED, that Todd County recognizes and supports watershed-scale planning efforts consistent with Minnesota Statutes, Chapter 103B.801, also known as One Watershed, One Plan; and
BE IT FURTHER RESOLVED that Todd County welcomes the opportunity to collaborate with the counties and soil and water conservation districts within the Mississippi River-Sartell Watershed for watershed-scale planning efforts in the future; and
BE IT FURTHER RESOLVED that Todd County supports an application to the Board of Water and Soil Resources for a planning grant to develop a comprehensive watershed management plan and anticipates entering into a Memorandum of Agreement with the counties and soil and water conservation districts within the Mississippi River-Sartell Watershed, to collaborate on this effort, pending selection as a recipient of a planning grant.
Soil & Water
On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote: To authorize the hiring of a Soil Health Practitioner.
County Sheriff
On motion by Noska and second by Neumann, the following motion was introduced and adopted by unanimous vote: Hire Cole Yungbauer for the Investigator position start date TBD at a wage of $36.04 Grade 11, Step 7.
Solid Waste
On motion by Denny and second by Neumann, the following motion was introduced and adopted by unanimous vote: To award the bid of $246,298.00 to North American Trailer for Walking Floor Trailers.
On motion by Denny and second by Neumann, the following motion was introduced and adopted by unanimous vote: To award the bid of $147,350.00 to Boyer Truck for Western Star model 47X.
On motion by Neumann and second by Denny, the following motion was introduced and adopted by unanimous vote: To approve the cost of refurbishing recycling bins by G&S Fabrication.
Administration
A special thank you to Kali Jo Covert for her efforts during a recent Amber Alert was expressed by the Todd County Board of Commissioners and the Todd County Sheriff’s Department.
On motion by Noska and second by Neumann, the following resolution was introduced and adopted by unanimous vote:
A RESOLUTION ESTABLISHING SUPPORT FOR SEEKING
FUNDING FROM SOURCEWELL FOR COMMUNITY IMPACT FUNDING
WHEREAS, Sourcewell is providing Community Impact Funding for Cities and Counties in Region Five, and;
WHEREAS, Todd County departments have identified projects that would provide improvements to the county’s equipment needs and its facilities that conform to the parameters of this grant opportunity.
NOW, THEREFORE BE IT RESOLVED that the Todd County Board of Commissioners approves the Sourcewell Community Impact Funding application submitted by Todd County Administration and;
BE IT FURTHER RESOLVED, That Todd County Board of Commissioners fully supports Todd County in implementing the purchase of a tracked skid loader, five measuring lasers for assessing property and office furniture including office and conference room chairs and desks. The Todd County Board of Commissioners further supports the Todd County Administration in submitting a Community Impact Funding application to Sourcewell to request financial support for in the amount of $50,000.00 for these projects.
On motion by Denny and second by Noska, the following resolution was introduced and adopted by unanimous vote:
ADOPTION OF CHANGES
TO THE TODD COUNTY
PERSONNEL POLICY
WHEREAS, the Todd County Board of Commissioners has recognized a need for a strong, up-to-date personnel policy, and;
WHEREAS, the Todd County Board of Commissioners and Policies Subcommittee have had an opportunity to review the policy revisions put forth in Article III, Section 3.04, of the Personnel Policy and find the implementation to be in the best interest of the sound administration of the County.
NOW, THEREFORE BE IT RESOLVED, that Todd County Board of Commissioners adopts the attached changes to the Todd County Personnel Policy Article III, Section 3.04 and directs the County Coordinator to begin administration of said policy as of May 21, 2024, and;
BE IT FURTHER RESOLVED, that it is understood that this Resolution replaces and supersedes all prior County Board actions, oral or written, relating to the subject matter hereof.
Closed Session
Chair Becker closed the session at 10:17 a.m. pursuant to Minnesota Statute 13D.05 Subd 3 (c) 3 to develop or consider offers or counteroffers.
On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous vote: To reopen the session at 10:37 a.m.
Commissioner Noska exited the meeting at 10:38 a.m.
County Auditor-Treasurer’s Report
The County Auditor-Treasurer provided notification that candidate filing opened this day for county, state, federal and judicial offices and will remain open until 5 p.m. on June 4, 2024.
County Attorney’s Report
The County Attorney is working through the processes to fill open positions in the office.
County Coordinator’s Report
The County Coordinator has been meeting with many to learn about Todd County and projects in progress including the HHS division.
County Commissioner’s Report
The Commissioners reported on meetings and events attended.
Commissioner Denny attended regular meetings and expressed thanks for the recent upkeep/cleaning of our roadways and ditches.
Commissioner Becker attended the public health, MTWCHB, dept head, SWCD, Rainbow Rider, Personnel, Friendly Rider, Long Prairie 1W1P, Facilities and AMC zoom meeting.
Commissioner Neumann attended the public health, dept head, Tri-Cap, SWCD, Solid Waste, Rainbow Rider, Personnel, Douglas Co P&Z, CMCOA, SRWD 1W1P, CPT and SRWD meetings.
