ORDINANCE NO. 538
AN ORDINANCE REGARDING THE SALE OF PROPERTY
THE CITY OF STAPLES DOES ORDAIN AS FOLLOWS:
Sec. 1 The City of Staples is hereby empowered to sell the following real estate located in the City of Staples, County of Wadena, State of Minnesota in accordance with the sale price to be authorized by the City Council:
That part of the Northeast Quarter of Section 35, Township 134 North, Range 35 West, Wadena County, Minnesota, described as follows:
Commencing at the southwest corner of said Northeast Quarter; thence South 89 degrees 54 minutes 46 seconds East, along the south line of said Northeast Quarter, a distance of 561.61 feet; thence North 00 degrees 05 minutes 14 seconds East, a distance of 33.00 feet to the point of beginning of the easement to be described; thence North 47 degrees 06 minutes 14 seconds East, a distance of 369.62 feet; thence South 89 degrees 54 minutes 46 seconds East, a distance of 149. 76 feet; thence South 35 degrees 03 minutes 46 seconds East, a distance of 308.20 feet; thence North 89 degrees 54 minutes 46 seconds East, a distance of 82.29 feet; thence North 35 degrees 10 minutes 08 seconds West, a distance of 335.45 feet; thence South 89 degrees 58 minutes 52 seconds West, a distance of 291.74 feet; thence South 46 degrees 59 minutes 52 seconds West, a distance of 400.19 feet; thence South 89 degrees 54 minutes 46 seconds East, a distance of 97.74 feet to the point of beginning.
Reserving unto the Grantor a utility easement over, under, and across the above- described property.
Sec. 2 The City Council finds that the property creates a net financial burden on the City and therefore should be sold for the sum of $1.00.
Sec. 3 The net proceeds from the sale shall be used pursuant to Section 11.05 of the Staples City Charter.
Sec. 4 The Mayor and City Administrator are authorized to execute any documents to complete the sale.
Sec. 5 This ordinance shall take effect from and after its passage and publication in accordance with law.
