June 6, 2017
Call to Order
The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 6th day of June, 2017 at 9:00 a.m. The meeting was called to order by Chairperson Erickson. The meeting was opened with the Pledge of Allegiance. All Commissioners were present with Commissioner Kneisl absent.
Approval of Agenda
On motion by Becker and seconded by Neumann, the following motion was introduced and adopted by unanimous vote. To approve the agenda as presented with the addition of 9.3 Buffer Initiative Project - Grant Info Update.
Consent Agenda
On motion by Kircher and seconded by Becker, the following motions and resolutions were introduced and adopted by unanimous vote:
To approve the Commissioner’s Meeting Minutes for May 16, 2017 as presented.
GAMBLING PERMIT – CHI HEALTH AT HOME
WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for CHI Health at Home through this resolution;
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for CHI Health at Home to hold a raffle at Greystone Golf Club in Kandota Township at the address 10548 Andres Drive, Sauk Centre, MN on August 26, 2017.
Auditor-Treasurer
On motion by Neumann and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the May 2017 Auditor Warrants number 229481 thru 229746 in the amount of $10,097,147.76.
On motion by Kircher and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the Commissioner Warrants number 46143 through 46269 in the amount of $114,638.69.
On motion by Becker and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Health & Human Services Warrants number 512617 through 512649 in the amount of $49,744.98 and Warrants number 700616 through 700786 in the amount of $122,632.06.
On motion by Kircher and seconded by Becker, the following resolution was introduced and adopted by unanimous vote:
TRANSFER OF FUNDS FROM GENERAL FUND TO COMMUNITY
CORRECTIONS FUND
WHEREAS, The 2017 Budget for Todd County’s participation in the Todd-Wadena Community Corrections system has been approved at $352,873.00; and
WHEREAS, a letter was received asking for the appropriation of funds from the General Fund.
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby approve the transfer of the funds in the amount of $352,873 from the General Fund to Community Corrections Fund.
Facilities Committee
On motion by Becker and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To acknowledge the fairgrounds repairs in response to the MCIT summary report to restore the Todd County Fairgrounds complex within safety compliance standards.
County Attorney
On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To increase the part-time legal assistance position from 24 hours per week to full-time, 40 hours per week and begin recruiting to fill the full-time legal assistant position.
Public Works
On motion by Becker and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To accept the resignation of Charles Thieschafer effective May 16, 2017.
On motion by Neumann and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve the Public Works Department to waive the 90 day waiting period to begin the internal and external recruitment process to fill the vacant Heavy Equipment Operator position.
On motion by Kircher and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the Cooperative Construction Agreement for the Replacement of Bridge #R0408 (Iona Township).
On motion by Kircher and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Cooperative Construction Agreement for the 2019 Angler Drive Project in Grey Eagle and Birchdale Townships.
On motion by Kircher and seconded by Becker, the following resolution was introduced and adopted by unanimous vote:
MnDOT AGREEMENT 1027368 –
TRUNK HIGHWAY 27/71 PROJECT IN LONG PRAIRIE
WHEREAS, the Minnesota Department of Transportation (MnDOT) plans on performing a bituminous mill and overlay, ADA improvements, signal revision construction, and other associated construction upon, along and adjacent to Trunk Highway 71 from 650 feet south of 6th Street SE to the south end of Long Prairie River Bridge and on Trunk Highway 27 from the north junction of Trunk Highway 27 and Trunk Highway 71 to 9th Street SE in Long Prairie, and;
WHEREAS, the State has requested the County to participate in the cost of the signal system revision construction and associated construction engineering, and;
WHEREAS, the County wishes to participate in the cost of the signal system revision construction and associated construction engineering under SAP 077-638-016, and;
WHEREAS, Agreement 1027369 between the State and the City of Long Prairie will address the City’s associated cost share, and;
WHEREAS, Agreement 69320 between the State, Todd County, and the City of Long Prairie addresses operation and maintenance obligations of the traffic signal, and;
WHEREAS, Minnesota Statute §161.20 subdivision 2(b) authorizes MnDOT and Todd County to enter into this agreement.
NOW, THEREFORE BE IT RESOLVED, that Todd County enter into MnDOT Agreement #1027368 with the State of Minnesota, Department of Transportation for the following purposes:
To provide for payment by the County to the State of the County’s share of the costs of the traffic signal revision construction and other associated construction to be performed upon, along and adjacent to Trunk Highway 71 from 650 feet south of 6th Street SE to the south end of Long Prairie River Bridge and on Trunk Highway 27 from the north junction of Trunk Highway 27 and Trunk Highway 71 to 9th Street SE in Long Prairie under State Project 7704-14 (TH 27=135) and 7707-24 (TH 71=004).
NOW, THEREFORE BE IT FURTHER RESOLVED, that the Chairperson of the Todd County Board of Commissioners and the Todd County Auditor/Treasurer are authorized to execute Agreement #1027368 and any amendments to the Agreement.
On motion by Becker and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote:
MnDOT MASTER
PARTNERSHIP
CONTRACT
(AGREEMENT 1028415)
WHEREAS, The Minnesota Department of Transportation wishes to cooperate closely with local units of government to coordinate the delivery of transportation services and maximize the efficient delivery of such services at all levels of government; and
WHEREAS, MnDOT and local governments are authorized by Minnesota Statutes sections 471.59, 174.02, and 161.20, to undertake collaborative efforts for the design, construction, maintenance and operation of state and local roads; and
WHEREAS, MnDOT and Todd County wish to be able to respond quickly and efficiently to such opportunities for collaboration, and have determined that having the ability to write “work orders” against a master contract would provide the greatest speed and flexibility in responding to identified needs.
NOW, THEREFORE BE IT RESOLVED, that Todd County enter into MnDOT Master Partnership Contract (Agreement 1028415) with the Minnesota Department of Transportation, a copy of which was before the County Board.
NOW, THEREFORE BE IT FURTHER RESOLVED, that the Chairperson of the Todd County Board of Commissioners and the Todd County Auditor/Treasurer are authorized to execute Agreement 1028415 and any amendments to the Agreement.
NOW, THEREFORE BE IT FURTHER RESOLVED, That the Todd County Engineer is authorized to negotiate work order contracts pursuant to the Master Contract, which work order contracts may provide for payment to or from MnDOT, and that the County Engineer may execute such work order contracts on behalf of the Todd County without further approval by this Board.
Ditch Inspector
On motion by Neumann and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To acknowledge receipt of a Hold Harmless Agreement for CD33 from Pete Bosl in Reynolds Township Sections 32 and 33.
On motion by Kircher and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the Brush Control project on County Ditch 19 to be performed by Central Applicators, Foley, MN at an estimated cost of $15,024.90.
Soil & Water
Tim Stieber presented information on the impending implications of the new Buffer Law requirements and funding.
Administration
On motion by Neumann and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the staff recommendation of hiring Gallagher Consulting to analyze our benefit plan and taking our health insurance plan out for bid.
Auditor-Treasurer’s Report
The first half of Property Taxes have been processed and apportionments settled to taxing jurisdictions. Preparations are in the final stages for the Audit Presentation from CliftonLarsonAllen.
Commissioner’s Report
The Commissioners reported on the meetings that they had attended.
Coordinator’s Report
The Coordinator reported on the meetings attended and projects in-progress including updates concerning the Bonding Bill which included funding for the Eagle Bend High School Building and Debt repayment provisions extended to 6 years and are currently researching Grant Funding to repair the rock wall surrounding the Courthouse block.
Recess
Chairperson Erickson recessed the meeting until June 20, 2017.
